Please make yourself aware of the ingredients and usage instructions accompanying each of our products to make sure that they are safe for you to use. It will be your sole responsibility to take proper precaution/ professional medical advice before using any of our products. You agree that the Trost will not be responsible or liable for any product related issues including without limitation any allergic reactions to you on account of usage of our products. PAYMENTS

1. Prices for the respective Products are set out on the Website, and are incorporated into these Terms by reference. The prices of the Products are subject to change without any prior notice, and at the sole discretion of The Trost.
2. In respect of payment for any Product/s that are ordered on the Website, the User will have the option to make such payments by either credit card, debit card, net banking or on a ‘cash on delivery’ basis. If the Products are purchased on a ‘cash on delivery’ basis, then the logistics partner may charge certain nominal fees in respect thereof in addition to price of Product. The ‘cash on delivery’ may not be available for all purchases and might require you to make a purchase bearing a minimum value.
3. Upon initiating a transaction for purchase of any Product/s through credit card or debit card or net banking, the User will be directed to a secure payment gateway for making payment for the Products. In this regard, The Trost may enter into agreements with third-party payment gateway aggregators, and nodal banks for the purpose of collection, remittance and retention of the payments made by the User.
4. In respect of the payment mechanisms offered on the Website, and your use thereof, The Trost shall not be liable in any manner for any loss or damage that may be caused to you on account of any issues arising out of the transaction and/or the payment mechanism, including any interruption or cancellation thereof, for any reasons whatsoever.

SHIPPING AND DELIVERY

1. Shipping and Delivery of the Products that are ordered on the Website shall be undertaken by the Website through their logistics partner. The delivery charges in respect thereof will be reflected in the final statement of payments that are to be made by the User in respect of the Products. Orders are usually dispatched within 1 - 2 business days of payment of order Our warehouse operates on Monday – Friday during standard business hours, except on national holidays at which time the warehouse will be closed. In these instances, we take steps to ensure shipment delays will be kept to a minimum.
2. The Website maintains a strict no return policy. Accordingly, The Trost shall not accept any return requests from Users in respect of any Products that are sold and delivered.
3. If any of the Products are damaged during transit, or if the expiry date in respect of any of the Products has already passed as on the date of delivery thereof, or there are any other defects in the Products, then such Products may be returned to the Website for replacement.

When The Trost is threatened with suit or sued by a third party, The Trost may seek written assurances from you concerning your promise to indemnify The Trost; your failure to provide such assurances may be considered by The Trost to be a material breach of this Agreement. The Trost will have the right to participate in any defence by you of a third-party claim related to your use of any of the Website content or Products, with counsel of The Trost choice at its expense. Herbidus Formulations Pvt. Ltd. will reasonably cooperate in any defence by you of a third-party claim at your request and expense. You will have sole responsibility to defend The Trost against any claim, but you must receive The Trost prior written consent regarding any related settlement. DISPUTE

1. Any disputes or differences arising under and in pursuance of these Terms and/or the Services shall be referred to the arbitration of a sole arbitrator to be jointly appointed by the Parties. If the Parties do not agree to the appointment of a sole arbitrator by the expiry of fifteen days from the date a Party has notified, in writing, the other Party of the existence of a dispute or difference, then the Hon’ble Delhi High Court shall appoint such sole arbitrator. The arbitration shall be governed by the provisions of the Arbitration and Conciliation Act, 1996 or any statutory modification, or re-enactment thereof, or any statute enacted to replace the same in force from time to time. The arbitration proceedings shall be held in English language and shall be held at New Delhi. The sole arbitrator shall have summary powers and be entitled to give interim directions and awards from time to time. The cost of the arbitration proceedings shall be borne by the Parties in equal shares.

 

GENERAL

1. Force Majeure. The Trost will not be deemed in default hereunder or held responsible for any cessation, interruption, or delay in the performance of its obligations hereunder due to earthquake, flood, fire, storm, natural disaster, an act of God, war, terrorism, armed conflict, labour strike, lockout, or boycott.
2. Cessation of Operation. The Trost may at any time, in its sole discretion and without advance notice to you, cease operation of the Website and distribution of the Products.
3. Entire Agreement. This Agreement comprises the entire agreement between you and The Trost and supersedes any prior agreements pertaining to the subject matter contained herein.
4. Effect of Waiver. The failure of The Trost to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.
5. Governing Law, India. This Agreement will be governed by the laws of the State of Himachal Pradesh without regard to its conflict of law principles to the contrary. By using this Website or ordering Products, you consent to the jurisdiction and venue of such courts in connection with any action, suit, proceeding, or claim arising under or by reason of this Agreement.
6. Statute of Limitation. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website or Products or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.
7. Waiver of Class Action Rights. BY ENTERING INTO THIS AGREEMENT, YOU HEREBY IRREVOCABLY WAIVE ANY RIGHT YOU MAY HAVE TO JOIN CLAIMS WITH THOSE OF OTHER IN THE FORM OF A CLASS ACTION OR SIMILAR PROCEDURAL DEVICE. Following termination, you will not be permitted to use the Website and The Trost may, in its sole discretion and without advance notice to you, cancel any outstanding orders for Products. This Agreement will survive indefinitely unless and until The Trost chooses, in its sole discretion and without advance to you, to terminate it.

Return, Refund and Replacement Policy

At The Trost, we endeavour to provide the best shopping experience for our customers. This Return, Refund and Replacement Policy outlines the conditions under which returns, replacements, and refunds are accepted, and your rights as a consumer under the Consumer Protection Act, 2019.

1. Terms of Return and Replacement

1.1 General Policy

The Trost does not accept returns or replacements on the basis of change of mind or personal preference. Returns and replacements are accepted only where the product delivered is Wrong or Defective, as described in this Policy.

1.2 How to Initiate a Return or Replacement

If you have received a Wrong or Defective product, you must initiate a return or replacement request within 7 days of delivery by:

You will be required to provide a copy of the original invoice and clear images of the defective or wrong product at the time of raising the request.

1.3 Return Shipping

Where the return is validated digitally, The Trost will arrange and bear the cost of return pickup wherever available. In locations where pickup is not available, you may be required to self-ship the product to our warehouse. The return shipping address will be communicated to you upon acceptance of your request. Self-ship costs in such cases will be reimbursed by The Trost upon submission of the courier receipt.

1.4 Eligible Grounds for Return or Replacement

Returns or replacements will be accepted only for the following reasons:

1.     The product delivered has crossed its expiry date

2.     The product has a leakage or spillage issue attributable to manufacturing or packaging

3.     The product delivered is incorrect (wrong SKU, variant, or item)

4.     The product has missing parts or accessories as listed on the product page

 

1.5 Grounds on Which Returns Will Not Be Accepted

Returns and replacements will not be accepted in the following circumstances:

1.     The product has been used or opened (unless the defect is only discoverable upon opening)

2.     The product has been damaged due to misuse, overuse, or negligence

3.     The product was received as a free gift or as part of a promotional bundle

4.     The product is missing its original packaging, tags, labels, or accessories

5.     The serial number or barcode on the product has been tampered with

 

1.6 Condition of Returned Products

Returned products must be in unused condition with original packaging and receipt intact, except where the defect requires opening to be identified. All returned products are subject to inspection and verification by The Trost. The following terms apply:

•       Returns are subject to quality inspection by The Trost upon receipt

•       Damage attributable to customer misuse or negligence will not be covered under this Policy

•       Once a return or replacement request is accepted, the process will be completed within 7–10 business days

•       In case of replacement, fulfilment is subject to stock availability. Where replacement is not possible, a full refund will be issued within the timelines specified in Section 2

2. Refunds

2.1 Refund Processing

Once your return request is received and the product is inspected, you will receive an email notification confirming whether your refund has been approved or rejected. Refunds will not be processed if the returned product fails quality inspection.

2.2 Refund Timelines

If your refund is approved, it will be credited to your original payment method within the following timelines:

•       Credit / Debit Card: 5–10 business days from approval

•       UPI / Net Banking / Wallets: 3–5 business days from approval

•       Cash on Delivery (COD): refund will be processed to your registered bank account within 7–10 business days. You will be required to provide your bank account details upon request

2.3 Proof of Return

If The Trost does not receive the returned product or the package is found to be empty upon receipt, you will be required to furnish proof of delivery (e.g., courier tracking confirmation). Refunds will only be processed after the returned product is received and inspected.

2.4 Sale Items

Items purchased at a discounted or sale price are not eligible for refunds on the basis of change of mind. However, if a sale item is defective or wrong, your rights under this Policy and under the Consumer Protection Act, 2019 remain fully applicable.

3. Consumer Rights

Nothing in this Policy limits or excludes any rights you may have under the Consumer Protection Act, 2019 or any other applicable law. If you believe your consumer rights have been violated, you may escalate your complaint to the relevant Consumer Disputes Redressal Forum.

If your return or refund request is rejected and you believe the rejection is unjustified, you may escalate your concern to our Grievance Officer:
